Revocation of Licence

The Fit and Proper Person test:

On occasions, where a landlord has been prosecuted and convicted for renting out an unlicensed property whether HMO or selective licence before the Courts OR they are convicted for Breach of their HMO licence conditions, if they have other rental properties, the licence for those properties can be revoked on the grounds that the Landlord is no longer considered a “fit and proper person” to hold a licence. This could have a huge financial impact on a landlord with a property portfolio, as it means that they will be unable to earn from those properties for several years.

It is therefore imperative that specialist and immediate legal advice is sought as soon a landlord receives a notice that states the Council is considering revoking their licence as they have been deemed to no longer be a “fit and proper person” to hold their property licence.
